Terms of service

1. Agreement and service provider

These Terms form a contract between you and FUTUREFORGE LABS SRL, registered office at Str. Ion Țuculeșcu nr. 8C, Timișoara, județul Timiș, România, trade register no. J35/705/2024, fiscal code 49616330, EUID ROONRC.J35/705/2024 ("Futureforge", "we", "us"). Futureforge provides OwnCadence. Contact: hello@owncadence.com.

By creating an account or using the application, you confirm that you have read and agree to these Terms. If you do not agree, do not create an account or use the service. Browsing the public website remains subject to the provisions that naturally apply to it, including intellectual-property, acceptable-use, and liability provisions.

2. Eligibility and your account

• You must be at least 18 years old and legally able to enter into this agreement.
• You must provide accurate account information and keep it reasonably current.
• Your account is personal. Do not share access, impersonate someone else, or create an account for a person without authority.
• You are responsible for protecting your identity-provider account and device and for promptly reporting suspected unauthorized access.

Authentication is provided through Auth0. We may require reasonable verification before restoring access, exporting data, changing sensitive settings, or processing a deletion or rights request. We may refuse a request where identity cannot be safely confirmed, while explaining available alternatives where law requires.

3. What OwnCadence provides

OwnCadence is a mobile-first web service that helps you define one personal productivity or routine goal, create a bounded weekly program, mark actions, record check-ins and reflections, review evidence, and consider proposed adjustments. The plan and memory are editable and designed to remain understandable to you.

The current service does not execute actions in your email, calendar, workplace, bank, health record, or other third-party system; provide a human coach; offer team or social features; or monitor you continuously. Features described as planned, preview, pilot, beta, or disabled are not promised until made available in your account.

You decide your goal and remain responsible for your choices, schedule, actions, and the consequences of using a suggestion. OwnCadence does not guarantee that you will complete a goal, change a habit, save time, improve wellbeing, or achieve a particular outcome.

4. AI disclosure and service boundaries

• OwnCadence is not a doctor, therapist, psychologist, dietitian, lawyer, financial adviser, emergency dispatcher, or crisis service.
• It does not diagnose, treat, cure, prevent, or monitor a medical or mental-health condition and does not replace professional advice.
• Do not rely on it for an emergency, medication, treatment, self-harm or violence response, nutrition prescription, legal deadline, financial transaction, or another high-impact decision.
• Verify information that matters and consult a qualified professional for professional or safety-critical guidance.

The service may interrupt ordinary coaching when text appears to indicate an acute safety concern and show local emergency or professional resources. This automated safeguard is limited and can miss or misunderstand a situation. It is not monitoring, rescue, or emergency dispatch. If there is immediate danger in the EU, call 112; elsewhere call the local emergency number.

AI can draft an explanation, routine, memory candidate, or adjustment, but deterministic product rules validate proposals and your acceptance is required before an important plan change becomes active. You can edit, reject, keep the current plan, correct memory, or stop using the feature.

5. Your content and privacy

You retain the rights you have in goals, notes, reflections, check-ins, preferences, and other content you submit ("User Content"). You give Futureforge a limited, non-exclusive, worldwide licence to host, copy, transmit, format, analyse, and otherwise process User Content only as needed to provide, secure, support, and lawfully improve the service, comply with law, and exercise or defend legal rights. This licence ends when the data is deleted, except for lawful retention and backup cycles described in the Privacy notice.

You must have the right to submit User Content. Do not enter confidential information belonging to an employer or another person, detailed medical records, illegal content, or personal data about someone else unless you have a lawful reason and it is genuinely necessary. We may remove or restrict content that violates these Terms or the law.

We do not claim ownership of User Content and do not sell it. We do not use your account content to train a general-purpose OwnCadence model. The configured business API provider states that API inputs and outputs are not used to train its general models by default; provider handling is described in the Privacy notice.

6. Acceptable use

Use OwnCadence lawfully, personally, and in a way that does not harm other people, the service, or its providers. You must not:

• break the law, violate another person's rights, harass, threaten, exploit, or facilitate harm;
• upload malware, attempt unauthorized access, probe or overload infrastructure, bypass rate limits or safety controls, or interfere with service integrity;
• reverse engineer, scrape, systematically extract, resell, frame, or copy the service except where applicable law expressly permits it;
• misrepresent AI output as professional or human advice, use it to deceive, impersonate, spam, or create unlawful content;
• use OwnCadence to make or support high-impact decisions about another person in employment, education, credit, insurance, housing, healthcare, legal services, or access to essential services;
• use automated means to create accounts or send bulk requests without our written permission; or
• share credentials, access another person's account, or attempt to recover content that you are not authorized to receive.

We may use proportionate technical controls to prevent abuse and investigate credible violations. Enforcement considers context, severity, repetition, safety, and legal duties.

7. Our intellectual property and feedback

Futureforge and its licensors own OwnCadence, including software, design, branding, text, graphics, product structure, and other materials, excluding User Content and third-party materials. Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable right to use the service for its intended purpose. No other rights are granted.

If you voluntarily send product feedback, you allow us to use it without restriction or payment to improve the service, provided we do not publicly identify you without permission. Feedback does not transfer ownership of your separate User Content.

8. Availability, updates, and beta features

We aim to operate OwnCadence with reasonable care, but uninterrupted or error-free availability is not guaranteed. Maintenance, security incidents, provider failures, internet conditions, capacity, or legal requirements can temporarily limit service. Keep independent copies of information you cannot afford to lose; the export feature is available for portability, not as your sole backup system.

We may add, change, suspend, or retire features to improve safety, reliability, usability, or legal compliance. We will give reasonable notice before a change that materially reduces a core contracted feature when practicable, unless urgent security, safety, legal, or provider circumstances require faster action. Preview or beta features may be less reliable and may be withdrawn.

9. Fees and future paid services

The current initial service is offered without a subscription charge unless a price and order summary are clearly shown to you before activation. We will not charge you merely for creating an account under these Terms.

If we introduce a paid plan, purchase, or trial, we will show the total price, applicable taxes, billing frequency, renewal and cancellation rules, key functionality, and any statutory withdrawal information before you place the order. Additional payment or plan terms presented at checkout will form part of the agreement. No future pricing statement changes an already completed order retroactively.

10. Suspension, termination, and account deletion

You may stop using OwnCadence at any time. You can request a portable export and request account deletion in the application. Account deletion starts a 7-day recovery grace period during which mentoring and ordinary notifications are suspended; you can cancel deletion during that period. After the grace period, deletion proceeds as described in the Privacy notice.

We may temporarily restrict or suspend access where reasonably necessary to protect an account, investigate abuse, comply with law, prevent harm, respond to a provider incident, or address a material breach. Where appropriate, we will explain the reason and give you a chance to remedy it. We may terminate for a serious or repeated breach, unlawful use, or where continuing the service is legally or technically impossible. Urgent action may occur without advance notice.

When the agreement ends, your right to use the service ends. Provisions that by their nature must continue—including ownership, lawful retained-data handling, liability limits, dispute rules, and accrued rights—survive. If we discontinue the whole service, we will provide reasonable notice and an export opportunity where practicable and lawful.

11. Service disclaimers

To the extent permitted by law, OwnCadence is provided as available for personal productivity support. Suggestions are informational and depend on the data you provide. We do not promise a particular result, uninterrupted access, compatibility with every device, or that every AI output will be accurate or suitable.

These disclaimers do not exclude the legal guarantee of conformity, reasonable skill and care, or another mandatory protection that applies to a consumer. If the service is defective, contact us so we can investigate and provide the remedy required by applicable law.

12. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, wilful misconduct, or death or personal injury caused by negligence where applicable law does not allow exclusion, nor does it limit mandatory consumer remedies.

To the extent permitted by law, Futureforge is not responsible for loss that was not a reasonably foreseeable result of our breach, for business or professional losses arising from personal consumer use, or for loss caused by your unlawful use, failure to follow clear safety information, or an external service outside our reasonable control. We remain responsible where and to the extent the loss was caused by our breach of contract or legal duty.

You should not use OwnCadence as the only repository for irreplaceable information or as the basis for a medical, emergency, legal, financial, employment, or other high-impact decision. This allocation of responsibility is part of the agreement but applies only to the extent allowed by law.

13. Governing law and disputes

Please contact hello@owncadence.com first so we can try to resolve a concern directly. If you are a consumer, you may also use any competent consumer-protection or alternative-dispute-resolution body. In Romania, information about Alternative Dispute Resolution is available from ANPC.

These Terms are governed by Romanian law. If you are a consumer habitually resident in another country, this choice does not deprive you of mandatory protections granted by the law of your residence. Courts have jurisdiction according to applicable consumer and procedural law; these Terms do not force a consumer to bring a claim in a court that mandatory law does not permit.

14. General terms and contact

We may update these Terms for legal, security, provider, or material product changes. We will publish the new version and date and provide reasonable advance or prominent notice for a material change where required. Changes do not retroactively remove accrued rights. Continued use after the effective date means the updated Terms apply; if you do not agree, you may stop use and delete the account.

If a provision is invalid or unenforceable, the remaining provisions continue, and the affected provision applies to the greatest lawful extent. A delay in enforcing a term is not a waiver. You may not transfer the account or agreement without our consent; we may transfer the agreement as part of a lawful reorganization or service transfer without reducing your mandatory rights. These Terms, any checkout terms, the Privacy notice, and specifically incorporated notices are the agreement for the service.

The English and Romanian versions are intended to be equivalent. If they differ, the Romanian version governs to the extent permitted by applicable law. Headings are for readability and do not change meaning.
